Experienced USERRA Lawyer

Joe Napiltonia provides tough, aggressive, representation to clients. Joe has handled over 30 cases as lead counsel, in less than six years, in federal district courts around the country. In addition, Joe has handled countless USERRA disputes as a USERRA ombudsman/mediator for the Department of Defense's Employer Support of the Guard and Reserve (ESGR). Joe is published on the subject of USERRA and testified in March 2014 before the U.S. Senate regarding amendments to USERRA that have bipartisan support, including adding punitive damages as a remedy against employers who violate service members' rights. Joe lectures on the topic of USERRA to the trial lawyers, National Guard Units and corporations, including Hospital Corporation of America.

What Will My Case Cost Me?

Litigation is expensive. Our firm has the financial resources to mount a formidable prosecution of your claim. In most cases, we work on a contingency fee arrangement that give our clients the security of knowing that they will not have to come up with attorney's fees on the front end to prosecute their claim. Rather, we will collect our attorneys' fees and any costs we advanced on the client's behalf out of their recovery. In addition, USERRA has a provision where a court can order your employer to pay your attorney's fees and costs if you are successful at trial.

National USERRA Practice

Joe Napiltonia has a national USERRA practice. By working with local counsel, Joe is able to be quickly admitted to any federal district court in the country. This process usually takes less than two weeks. Joe has represented clients in:
