Wrongful Death

Nothing is worse than losing a loved one. In Tennessee, the law recognizes that if an individual dies as a result of another person's negligence, a family member can bring a wrongful death lawsuit. Generally, the spouse of the decedent has the right to bring the lawsuit. If the decedent was unmarried but had children, the children have the right to bring the lawsuit. If the decedent was unmarried and his or her children are minors, the court will appoint a guardian to bring the lawsuit on behalf of the children. If the decedent has no spouse and no children, his or her parents have the right to bring the lawsuit.
